Terms and Conditions (T&C)
1. Purpose
These Terms and Conditions (T&C) define the terms and conditions under which Productions Patric Favreau (hereinafter referred to as “the Provider”) offers mixing and mastering services (hereinafter referred to as “the Services”) to its clients (hereinafter referred to as “the Client”).
2. Services
The Provider offers audio mixing and mastering services. The specific details of each service are defined on our website, in a quote, or in a separate contract approved by the Client.
3. Order
Any order for Services must be confirmed in writing (email, signed contract, etc.) or placed through our website. The order will become effective upon receipt of the deposit (if applicable) and written confirmation from the Client or upon validation of the order on the website.
4. Pricing and Payment
The prices of the Services are indicated on our website and in the quote provided to the Client. Prices are in Canadian dollars and may be changed at any time, but modifications will not apply to orders that have already been confirmed. Unless otherwise specified, payments must be made as follows:
A 50% deposit upon order confirmation (except for orders placed through the website).
The remaining balance upon delivery of the Services (except for orders placed through the website).
5. Deadlines
The completion deadlines for the Services will be defined in the quote or contract. The Provider commits to meeting the agreed deadlines, except in cases of force majeure or delays attributable to the Client (late payment, late submission of necessary materials, etc.).
6. Client Obligations
The Client agrees to provide all necessary information and files for the execution of the Services within the agreed timeframe. The Client is responsible for the quality and legality of the files provided.
7. Intellectual Property
The Provider retains intellectual property rights over the techniques and tools used for the execution of the Services. The Client retains ownership of their original creations. The Provider may not use the Client’s creations for commercial purposes without the prior consent of the Client.
8. Confidentiality
The Provider agrees to keep confidential all information and files provided by the Client in connection with the execution of the Services, provided that the Client expressly states their confidentiality requirements during and/or after the completion of the service.
9. Liability
The Provider commits to delivering the Services with the necessary professional care and expertise. In case of non-compliance with the Services, the Provider agrees to rectify the defect or refund the Client, without the Client being able to claim any additional damages.
10. Refund Policy
The Provider does not offer refunds for Services rendered. Once the Services have commenced, no refund requests will be accepted, regardless of the reason.
11. Right of Withdrawal
The Client has a right of withdrawal of 14 days from the confirmation of the order. However, this right of withdrawal does not apply once the Services have commenced with the Client’s consent before the end of this period.
12. Disputes
In the event of a dispute, the parties agree to seek an amicable resolution before taking any legal action. If no amicable solution is reached, the courts of the province of Quebec (Canada) shall have exclusive jurisdiction.
13. Acceptance of the T&C
Confirmation of the order by the Client implies unconditional acceptance of these T&C.
